These Terms of Use ("Terms") govern your use of Cave ("the App"), developed by Melvin Morina ("we", "us", "our"). By downloading, installing, or using Cave, you agree to these Terms.

1. Acceptance of Terms

By using Cave, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Description of Service

Cave is a personal journaling app that allows you to record video journal entries. Ember, your companion within Cave, provides personalized reflections based on what you share. Cave is designed for personal self-reflection and is not a substitute for professional mental health care, therapy, or medical advice.

3. Eligibility

You must be at least 13 years old to use Cave. If you are under 18, you must have permission from a parent or legal guardian.

4. Account & Data

Cave does not require an account, login, or registration. All your data is stored locally on your device. You are responsible for maintaining the security of your device and backups. We cannot recover lost data because we never have access to it.

5. Subscriptions & Payments

5.1 Subscription Plans

Cave offers the following auto-renewing subscription plans:

• Annual Plan — $49.99 per year ($4.17/month equivalent)
• Monthly Plan — $7.99 per month

5.2 Free Trial

New subscribers may be eligible for a 7-day free trial. During the trial, you have full access to Cave's features at no charge. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate.

5.3 Billing

• All payments are processed by Apple through the App Store. We do not collect or process payment information directly.
• Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• Prices are in US Dollars and may vary by region based on App Store pricing.

5.4 Cancellation

You can cancel your subscription at any time through your Apple ID settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period. You will retain access to Cave's features until the end of the period you've already paid for. No partial refunds are provided for unused portions of a subscription period.

5.5 Promotional Offers

We may occasionally offer promotional pricing (e.g., win-back offers for returning subscribers). Promotional pricing applies for the specified period only, after which standard pricing resumes.

6. Ember Responses

• Ember's responses are generated reflections, not professional advice. They are not a replacement for therapy, counseling, or medical treatment.
• Ember's responses are based on what you share and may not always be perfectly accurate or appropriate.
• If you are in crisis or experiencing a mental health emergency, please contact local emergency services or a crisis helpline in your area.
• We do not guarantee the availability, accuracy, or quality of Ember's responses. Responses may be affected by device capabilities, network conditions, or third-party service availability.

7. Acceptable Use

Cave is intended for personal journaling. You agree not to:

• Use Cave for any illegal or harmful purpose
• Attempt to reverse-engineer, modify, or tamper with the App
• Use the App to generate content that violates third-party rights
• Attempt to circumvent subscription requirements or exploit the service

8. Intellectual Property

Cave, including its design, code, visuals, Ember character, and all related content, is the intellectual property of Melvin Morina. You may not copy, modify, distribute, or create derivative works based on the App without explicit written permission.

Your journal entries remain your property. We claim no rights over your recorded content.

9. Disclaimer of Warranties

Cave is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Ember's responses will meet your expectations or be suitable for any particular purpose
• Defects will be corrected in any specific timeframe

10. Limitation of Liability

To the maximum extent permitted by law, Melvin Morina shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Cave, including but not limited to loss of data, emotional distress, or reliance on Ember's responses.

11. Indemnification

You agree to indemnify and hold harmless Melvin Morina from any claims, damages, or expenses arising from your use of Cave or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate access to Cave at our discretion, including for violation of these Terms. You may stop using Cave at any time by deleting the App.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of Cave after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Austria, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of Austria.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
